Details concerning the Spring convention in NY will be available soon. This is a CMA event, but CBI provides all broadcast related sessions as a service to CMA. The convention will be held March 17-19, 2005 at The Roosevelt Hotel in New York City. The broadcast portion of this event include 17 sessions in which we bring in NY working professionals to address the concerns of those considering a career in media. This event is focused. If you want inside information or your students want career tips, this is for the place to be. City To Take Action After Lexington Station Prank Goes "Up In Smoke"LEXINGTON, KY-November 11: A Lexington, KY, radio station says it was just a joke, but many listneers aren't amused after WXZZ deejays told listeners that a new smoking ban had passed at midnight the previous night prohibiting smoking in cars. No ban has been passed.

Speculation continues to run rampant concerning the future of the FCC. The wind blows the pundits in many directions. I have already posted my thoughts and won't rehash them for the sake of making "news".

On the tech front...

SPAM seems to increasing exponentially. Don't sign up for contests! Don't reply to SPAM and don't opt out, as you are normally opting into something else by verifying a valid e-mail address!

Live video over ethernet and Intnet II? Yes it is possible. Details coming soon at prices that are 10% of the Brick solution.

Can you make PEG work for you? Looking for success stories concerning cable access channels. I recently visited HMS which is a PEG channel that has its own equipment, building in Houston, etc. How can you leverage the local Franchise agreement? I can help!! I've done it.

There are between 17 and 22 station licenses being challenged! The basis for the challenge is found in the FCC rules (73.516) which state that stations must be on the air 12 hours per day/365 to avoid a challenge. CBI is following this closely! Pirate power-down plan is no goA pirate in Beaverton OR, operating on 98.1 mHz, has been hit with the standard 10K fine. The guilty party, David Michael Oaks, put up what was to us a novel defense. He said that every time he was warned to cut it out, he ratcheted down his power. However, he didn't know just how far down he had to go. Apparently, and FCC agent said that "...he could purchase a Part 15 wireless microphone to compare the range of his signal with that of his station." It's government advice on how to be a pirate along the lines of "That one-master is still too big, matey, best try a rowboat." Aaarrrggghhh! Oaks didn't bother with the microphone test. We don't know what the mic would've cost, but we'll bet it's less than 10K.

Webcast Metrics debuts new Internet radio ratingsThird party Internet radio audience ratings are once again available to subscribing webcasters and advertisers. Ending a more than six month void of ratings information for the Internet radio industry, Webcast Metrics released a ranker of the top 20 subscribing webcasters, with data collected for October. Webcast Metrics plans to publish regular monthly audience reports and subscribers will have access to additional detailed audience demo info. Since Arbitron closeted its Measurecast surveys last spring, the Internet radio industry has been without "exact data" third party measurement gathered from stations' servers. This data is converted to standard broadcast metrics such as average quarter hour (AQH), cume and total listener hours (TLH) using the same formulas as traditional broadcast ratings providers. Answer or Pay (or both!?)

Timing, confusion are no excuseThe 10K fine against American Family Association's KBMP-FM for a main studio violation and failure to respond to an FCC inquiry will stick. The station is licensed to Enterprise KS, and was being operated as a satellite of KCFN-FM Wichita. However, the operation took effect under those conditions on 3/6/02. Almost seven months prior to receiving an FCC waiver permitting the rebroadcast on 10/31/02. It was hit with a 7K fine for that, and then another 3K was tacked on when AFA failed to respond to FCC questions on the matter. The FCC refused AFA's appeal. The Commission noted that AFA was very familiar with the waiver rule, as it uses it all the time. It should have known that it was not permitted to set up such a situation prior to receiving the FCC's go-ahead. It had also been fined in the past for the exact same violation, at its KBKC-FM in Moberly MO. As for the response violation, AFA said "...it is sometimes confus ing to the public to understand the status of a matter in one department that was previously resolved by a different Bureau..." The Media Bureau found this argument without merit, saying that AFA had been put on notice that it was under investigation for the main studio rule violation, which should have eliminated any confusion when it came to answering the FCC's questions. Bottom line: the 10K fine sticks.

This blog is not linked anywhere and hasn't been updated since last week. Why does it exist?

This blog will soon replace the "news" link on the website as it allows multiple parties to post and an easy means of posting. That should read to you as this blog will soon have an audience.

So the next logical question is, why can't I just subscribe to the CBI list and get the info. The CBI list is meant as a discussion list. The blog does allow comments, but it meant to be a soap box in addition to news and content that is not highlighted elsewhere, including the CBI lists.

With that said, here are todays entries...

FCC auctions FMs for 100K apieceThat's the average, anyway, as the fifth round of FCC Auction No. 37 proceeds. Roughly 28.5M dollars have been placed on the table for 288 available licenses. The biggest bid is from Community Radio Inc., which is putting up just under 1.5M to get a CP in Brewster MA on Cape Cod. Community Radio is also the standing high bidder overall, with over 2.5M committed to four stations - - the others are in Pacific Junction IA, Normal IL and Palisade CO. It has also bid on eight additional stations, which currently are in the control of higher bidders - - they are in states such as Arizona, Iowa, Illinois, Kansas, Mississippi, New York, South Dakota and West Virginia. At this point in the auction, the rest of the top ten standing bid holderws are (2) Visionary Related Entertainment (2 stations, 1.018M); (3) College Creek Broadcasting (10 stations, 997K); (4) Cumulus (4 stations, 942K); (5) Am anda Mintz (1 station, 937K); (6) Aurora Communications (2 stations, 926K); (7) CODO Group (2 stations, 717.1K); (8) Jesse Porillo (2 stations, 678K); (9) Bigglesworth Broadcasting (4 stations, 523K); and (10) Christopher Miller (2 stations, 467K).

Yo ho ho and a bottle of rumWe call radio pirates pirates because, er, well, we do. But when one of them is operating from a room in the Rum Runner Caribbean Restaurant and Lounge, then they have truly earned the title Radio Pirate. This buccaneer is a member in good standing of the Orlando division in the burgeoning Florida pirate armada. His name is Everald Brown, and the action against his 95.9 mHz station has been kicking around the FCC for some time now (7/23/03 RBR Daily Epaper #143). As we wrote in the earlier item, Brown initially did not contest the FCC fine. We find out now that he thought it only a warning. Neither that nor his current plea of poverty have earned him a waiver or reduction of the fine. In the first instance, ignorance is no excus e. In the second, he didn't bother to document his poverty claim. So the fine sticks.

CBI has been reporting on the license renewal challendges. Allen Myers reported to CBI that there are currently 17 challenges being processed. The current CBI site reports fewer challenges, which suggests a growing trend.
